1. Agreement and scope
These Terms & Conditions apply to access and use of the SmartVerify website and services operated by MComm Technologies. A separate signed agreement, order form or customer-specific service schedule may add to or override these terms for an account.
2. What SmartVerify provides
SmartVerify provides a controlled workflow for selected identity, background, business, property, vehicle and compliance services. The current service catalogue identifies which dashboard pages and provider-backed actions are active. A listed or described service is not automatically available for every account or every purpose.
3. Accounts and authority
You must provide accurate account information, protect credentials, restrict access to authorised users and notify us of suspected compromise. You confirm that you have authority to use the account and submit each request. You may not use the service to harass, discriminate, impersonate, unlawfully surveil or make a decision that is prohibited by law.
4. Lawful purpose and consent
You are responsible for declaring a lawful purpose, confirming authority and obtaining consent where required before submitting information. You must provide appropriate notices to verification subjects and use results only for the purpose for which they were obtained. SmartVerify may block or review a request that appears unauthorised, unlawful, abusive or inconsistent with the selected service.
5. Verification results
Results depend on source availability, matching logic, data quality, technical conditions and the information submitted. A result is a decision-support signal, not a guarantee of identity, creditworthiness, ownership, safety or legal compliance. You must apply appropriate human review and independent checks for consequential decisions.
6. Pending, failed and uncertain outcomes
Provider timeouts, malformed responses, incomplete records, manual-review states and uncertain outcomes may be returned as review states. SmartVerify does not promise that an uncertain request will be retried or automatically converted into a completed result.
7. Credits, charges and refunds
Credits, prices and estimated costs shown in the portal are account or release-specific and may change. A request may reserve or charge credits according to the service workflow. Do not retry a pending or uncertain paid request unless the portal or support team explicitly instructs you. Refunds or reversals are handled according to the applicable account agreement and transaction evidence.
8. Prohibited use and security
You may not probe, overload, reverse engineer, bypass access controls, submit malicious files, share API credentials, scrape private data or interfere with another customer’s account. You must use secure transport, protect API keys and promptly report suspected misuse.
9. Intellectual property
SmartVerify branding, software, documentation, layouts and original visual assets belong to MComm Technologies or their licensors. You receive a limited right to use the service for your authorised internal business purposes. No ownership is transferred by account access or credit purchase.
10. Availability and third parties
We work to keep the service available, but source systems, networks, maintenance and third-party providers can affect availability. VerifyNow and other upstream providers are independent services. Their own terms, availability and privacy rules may apply to the relevant result.
11. Confidentiality and data protection
Each party must protect confidential information received from the other. Personal information must be handled in accordance with POPIA, the Privacy Policy, the POPIA notice and any applicable data-processing terms.
12. Liability and suspension
To the extent permitted by law, SmartVerify is not responsible for decisions made solely from a result, source inaccuracies, customer misuse, unauthorised requests or losses caused by information supplied by the customer. We may suspend access where necessary to protect the service, people, data or legal obligations.
13. Governing law and contact
These terms are governed by the laws of the Republic of South Africa unless a customer agreement provides otherwise. Questions about these terms should be sent to admin@smartverify.co.za.
